段一·现身

那根木头,三丈长,一个人扛得动。

第七十五夜。

强磊带马可去看了那个库。

库在村东头,一片空地上。一个很方的水泥建筑,白墙,蓝顶,门口有一块牌子:洛川县××村果业专业合作社气调库。牌子上还有一行小字:××年度农业产业化项目

门锁着。锁是新的,不,是很旧的锁,可上面没有锈,说明这三年里有人来开过、又锁上。

强磊从口袋里掏出一把钥匙。

“你有钥匙?”

“我爸有。”强磊说,“他是社员。”

门开了。

一股很凉的、带着水泥味的空气涌出来。

里面很大。空的。地上很干净,不,不是干净,是没有用过的那种干净。墙角堆着几个塑料筐,有一堆化肥袋子。

马可往里走。

他的脚步在空库里有回声。

他抬头看,顶上的制冷机组还在,管道也在。他伸手摸了一下墙上的开关面板,是凉的。

电闸拉了。

“强磊,”他说,“这库是好的。”

“我知道。”强磊说,“县里去年来检修过一次,说没毛病。”

“那为什么没人用?”

强磊没有回答。

他走到库门口,指了指外面那块空地。

“马哥,前年冬天,”他说,“那七家在这儿吵了一架。”

“吵什么?”

“存的说建库的骗了他们。建库的说是你们自己要存的。”

强磊蹲下来,用手划了划地上的土。

“最后有个人说了一句话。”

“什么话?”

“他说:‘你们要是有本事,你们自己先存啊。’”

马可站在那儿,忽然问:“谁说的?”

“合作社的一个理事。”强磊说。

“他自己存了吗?”

强磊愣了一下。

“……我不知道。”

他想了想,又说:“应该没有。他家苹果不多,就四亩。”

马可点了点头,把这一笔记在了本子上。

说“你们自己先存啊”的那个人,自己没存。

他这一行有一个说法,叫利益不一致。写在每一份尽调报告的公司治理那一节里,写得很规矩,很中性。

可放在一个村的空地上,它就是这么一句话:

劝你跳的人,站在岸上。


马可站在那个空库门口,忽然听见身后有人说话。

“他说得对。”

马可回头。

一个人站在库门外的空地上。

四十来岁,很瘦,穿一件很素的深色袍子。他的脸上没有什么表情,不是冷,是一种不打算让你看出什么的平

他手里拿着一卷竹简。

“先生您是,”

“公孙鞅。”那人说。

马可怔了一下。

“后来我封在商,”他说,“你们叫我商鞅。”


段二·古文镜像

“令既具,未布,恐民之不信,已乃立三丈之木于国都市南门,募民有能徙置北门者予十金。民怪之,莫敢徙。复曰:能徙者予五十金。有一人徙之,辄予五十金,以明不欺。卒下令。”
English Mirror: The laws were drafted but not yet promulgated, and he feared the people would not believe them. So he set a pole three zhang long at the south gate of the capital market and offered ten gold to any man who would carry it to the north gate. The people thought it strange, and none dared. He then said: fifty gold to whoever moves it. One man moved it, and was given fifty gold at once — to make plain there was no deceit. Only then were the laws issued.

“商先生,”马可说,“徙木立信那一段,我读过。”

“讲讲你读出了什么。”

马可想了想。

“您新法要颁布,怕百姓不信,所以立了一根木头,搬到北门给十金。没人搬。您加到五十金,有人搬了,您就当场给了。”

“对。”

“这是为了让百姓相信,朝廷说话算话。”

商鞅点了点头。

“大体不错。”他说,“可你漏了最要紧的一处。”

“哪一处?”

商鞅把那卷竹简换了只手。

为什么是五十金?

马可怔住了。

“……因为十金没人搬。”

“那为什么十金没人搬?”

马可老老实实想。

“因为,他们觉得这事太容易了。搬一根木头给十金,不合常理。他们怕是圈套。”

“对了一半。”商鞅说。

“那另一半呢?”

商鞅看着他。

因为搬的那个人,要当着全城的面搬。


段三·事件主体

马可站在那儿,忽然出了一身汗。

“商先生,您是说,”

“那根木头立在市南门。”商鞅说,“市是什么地方?是全国都人做买卖的地方。”

“那一天有多少人在看?”

“上千。”

他把那卷竹简在手里敲了敲:“年轻人,你想一想那个人的处境。”

“他要在上千人面前,走出人群,扛起那根木头,走到北门。”

“一路上所有人都在看他。”

“要是我不给钱呢?”

马可听懂了。

那个人赌的不是十金。

他赌的是:如果官府赖账,他就是那个当着全城的面被耍了的傻子。

“商先生,”他慢慢地说,“十金是那根木头的价钱。”

“可五十金,”

五十金是那个人丢脸的价钱。”商鞅说。


“年轻人,我再问你一句。”商鞅说。

“先生请讲。”

“我给了他五十金以后,你觉得,第二个人还需要五十金吗?”

马可想了想。

“不需要。”

“为什么?”

“因为第一个人已经拿到钱了。”马可说,“大家都看见了。”

“所以第二个人搬同样一根木头,给多少?”

“……可能十金就够了。”

“或者一金。”商鞅说,“或者不给钱,只要说一句‘这是官府的事’,就有人去做。”

他把竹简展开了一点:“第一个人的价钱,跟后面所有人的价钱,不是一回事。

“那五十金,”他说,“不是给他一个人的。”

“那是给谁的?”

商鞅抬起眼:

那是我买下了后面几十年,所有人肯信一次的价钱。

马可在心里飞快地算了一遍。

秦国从孝公变法到统一,一百三十多年。

五十金,买了一百三十年。

他忽然想起自己那一行给一样东西定价的方式:把未来所有的现金流,一年一年折回今天。

那五十金的账,也可以这么算,只不过折回来的不是钱,是每一次百姓不用再犹豫的那一瞬间

一百三十年,几千万人次。

分摊下来,每一次几乎是零。

可它必须由一个人,在一个下午,一次付清


马可站在那个空库门口,久久没有说话。

他忽然明白自己这几天一直在绕的那个问题。

那个库不动,不是因为没有规矩,是因为没有人肯当那根木头。

“商先生,”他说,“我这儿有一个库。”

“我知道。”商鞅说,“我看了一会儿了。”

“三年没人用。”

“为什么?”

马可把前年那件事讲了。七家存了两百吨,二月跌了,吵了一架,电闸拉了。

商鞅听完,问了一个问题。

“那七家,亏了多少?”

马可算了一下:“存了两百吨,跌了三毛,加上库费,大概每家一到两万。”

“那年建库的人,赔了他们钱吗?”

“没有。”

“那年建库的人,自己存了吗?”

马可停住了。

“……我不知道。”

商鞅点了点头,一点也不意外。

“年轻人,”他说,“你回去问。要是他们自己没存,”

“那这件事就不是亏了钱那么简单。”


马可在库门口的水泥台阶上坐了下来。

“商先生,”他说,“那要怎么重新开始?”

商鞅在他旁边站着。

你得立一根木头。

“怎么立?”

“三样。”商鞅说。

他伸出第一根手指:

第一,那件事要小。

马可怔了一下。

“搬一根木头,是天下最容易的事。”商鞅说,“一个人就搬得动,一炷香的工夫。”

“我要是让他去打一场仗,那就没意思了,他做不成,我这信也立不起来。”

“所以这件事必须小到没有人能说做不到。”

马可在本子上飞快地记。

“那第二样呢?”

商鞅伸出第二根手指:

第二,赏要重到不合理。

“不合理?”

“搬一根木头,十金已经是重赏了。五十金是荒唐。”商鞅说,“可正因为荒唐,人才会传。”

“传什么?”

“传‘那个人真拿到了五十金’。”商鞅说,“要是我给十金,百姓拿了就走了,第二天谁也不提。”

“可五十金,那件事全城说了三年。”


“第三样呢?”

商鞅停了一下。

然后他说了今夜最重的一句。

第三,钱要当场给,而且当着所有人给。

“为什么?”

“因为立信这件事,”商鞅说,“最怕的不是不给,是隔了一天再给。

马可怔住了。

“隔一天有什么不好?”

“隔一天,看见的人就散了。”商鞅说,“那个人回家跟别人说‘官府给了我五十金’,别人会说,谁知道呢。”

“可他要是当场在市南门拿到,上千人亲眼看见,”

他把手一摊:“那一千个人,每一个都是一张凭据。


马可坐在那个台阶上,忽然把这三条对着那个库套了一遍。

第一条:事要小。

不能让第一个人存一整年的果。要存,存一小部分。

第二条:赏要重到不合理。

不能只是“可能多卖两毛”。得有一个,不管涨跌都拿得到的东西。

第三条:当场给,当着所有人给。

不能等到二月开库卖了才算账。

他抬起头。

“商先生,我大概想到怎么做了。”

“讲。”

“第一,只存一小部分。比方说一万斤,不是全部。”

“第二,我垫钱。存进去的时候,我按当天的市价,先给他一半的钱。”

“不管二月是涨是跌?”

“不管。”马可说,“涨了,多的归他,我不分。跌了,我垫的那一半不要他还。”

商鞅眯起了眼睛。

“那你亏多少?”

马可算了一下。

“一万斤,按九毛,是九千。我垫一半,四千五。最坏的情况我全赔了,四千五。”

他抬起头:“商先生,四千五百块,就是我的五十金。”


商鞅没有立刻说话。

他在库门口来回走了两步。

“年轻人,你这个法子,有一个大毛病。”

马可心里一沉。

“先生请讲。”

你把自己变成了那个库。

马可怔住了。

“怎么讲?”

“你垫钱兜底,第一次可以。”商鞅说,“第二次呢?十户呢?一百户呢?”

马可算了一下,一百户,每户四千五,就是四十五万。

“我垫不起。”

“对。”商鞅说,“所以你那四千五,只能买一次。”

“买一次也值啊,”马可说,“第一根木头搬起来了,后面就好办了。”

商鞅摇头。

“不一定。”

“为什么?”

商鞅停下脚步,转过身。

因为他们会记住的不是‘存库可行’。

“他们会记住的是,‘马可这个人肯兜底’。”

马可像被人打了一拳。

“年轻人,这两件事差得远。”商鞅说,“第一件是规矩。第二件是,你这个人。”

“规矩,你走了它还在。”

“你这个人,”他看着马可,“你哪天不来了呢?”


马可在台阶上坐了很久。

“商先生,”他终于说,“那我该怎么办?”

商鞅在他旁边蹲了下来。

那是马可第一次看见这个人做出一个不那么端正的动作。

“年轻人,我给你讲我自己的事。”

“先生请讲。”

“我那五十金,立起来了信。新法颁下去,行了二十年。秦国大治。”

“可我死的时候,”他说,“是被车裂的。”

马可屏住呼吸。

“孝公死,太子即位。”商鞅说,“太子从前犯过法,我罚了他的师傅公子虔。他登基以后,公子虔告我谋反。”

“我逃了。”

“逃到哪儿?”

“逃到边境。”商鞅说,“天晚了,我要住店。”

“店主怎么说?”

商鞅笑了一下。那是马可今夜第一次看见他笑,那个笑很难看。

“店主说:‘商君之法,舍人无验者坐之。’

“意思是,商君的法规定了,收留没有身份凭证的客人,店主要连坐。”

马可闭上了眼睛。

“他不认得我。”商鞅说,“他只是照着我定的规矩,把我赶出去了。”

马可小心地问:“先生,您……没有亮明身份?”

“亮了。”商鞅说。

“他怎么说?”

“他说:‘你要真是商君,那你更该懂这个规矩。’”

马可闭上了眼睛。

“那您怎么办?”

“我走了。”商鞅说,“在外头待了一夜。”

他说得很平常,可马可听得出那底下的东西。

一个人定的规矩,在他最落魄的那一夜,把他挡在了门外。

而挡他的那个人,是照着他自己写的字在做事。


夜风从空库那边刮过来。

“商先生,”马可轻声问,“您当时想了什么?”

商鞅沉默了很久。

“我想的是四个字。”

“哪四个?”

为法之敝。

“什么意思?”

“唉,制定法令的人,最后被自己的法令害了。”商鞅说,“史书上记的就是这一句。”

他站起来,掸了掸袍子。

“可年轻人,我要跟你说,那一刻我心里其实是,松了一口气。”

马可怔住了:“松了一口气?”

“对。”商鞅说,“因为那一刻我知道,我那套法,是真的立住了。

“连我自己都逃不掉。”

他抬起眼:“年轻人,一条规矩,要是定它的人可以绕开它,那它就不是规矩,是他的方便。”

“我死在自己的法上,很难看。”

“可要是那个店主认出我,把我放进去了,”

他停了一下:

那我这二十年,才是白干了。


马可站起来。

他忽然完全明白了商鞅刚才那句话的意思。

四千五百块,能买第一根木头。

可如果所有人记住的是“马可肯兜”,那第二年马可不在的时候,这件事就停了。

要立的不是马可这个人的信用。

是一条不管谁来都照办的规矩。

“商先生,”他说,“我改一改。”

“讲。”

“那四千五,我不以我个人的名义给。”

“那以什么名义?”

马可想了很久。

“我立一个规矩。”他说,“写下来,贴在这个库门口。”

“写什么?”

马可在本子上一边写一边念:

凡在本库存果者:

一、存入当日,按当日市价先付五成。

二、开库售出后,售价高于存入价的部分,全归存果人。

三、售价低于存入价的,已付的五成不追。

四、此三条,写在这儿。谁来经办都照办。

五、这三条从今天起五年不改。要改,须提前一年公示。

他抬起头。

“商先生,这样行吗?”

商鞅看了很久。

第四条最要紧。”他说。

“为什么?”

“因为前三条讲的是钱。”商鞅说,“第四条讲的是,这不是你一个人的许诺。”

他顿了顿:“不过你还漏了一样。”

“漏了什么?”

商鞅指了指库门口那面白墙。

你得把第一个存的人,名字写在这儿。

马可怔了一下。

“为什么?”

“因为你这六条,”商鞅说,“讲的全是你会怎么做。”

“可百姓不看你说什么。”

他指着那面墙:“他们要看,谁已经站过去了。

马可站在那儿,忽然明白了。

那面墙上要写两样东西。

一样是规矩,那是给理性看的。

一样是名字,那是给胆子看的。

“商先生,”他说,“可要是那个人亏了呢?他的名字还在墙上。”

商鞅看了他一眼。

“那就让它在。”

“为什么?”

“因为你这六条里已经写了:亏了不追。”商鞅说,“那他的名字挂在那儿,不是耻辱。”

“那是什么?”

是证据。

他把袖子拂了一下:“证明这六条是真的。”


段四·钩子结尾

马可在库门口站了很久。

天快亮了。

商鞅要走了。他把那卷竹简收进袖子里。

“年轻人,最后一句。”

“先生请讲。”

“你那五条,写得不错。”商鞅说,“可你要记住一件事。”

“什么事?”

商鞅看着他,那双眼睛在晨光里没有什么温度。

那五条里,最难做到的不是第一条,是第五条。

马可怔住了。

“五年不改?”

“对。”

“为什么难?”

商鞅往空地那边走去,一边走一边说:

“因为第一年,你会发现这五条有毛病。第二年,会有人钻空子。第三年,你手上有更好的法子了。”

“那时候你会想改。”

他停在空地当中,回过头:

而你一改,前面四条就全废了。

“为什么?”

“因为百姓记住的从来不是条文。”商鞅说,“他们记住的是:这个东西改不改。”

“一条烂规矩守五年,比一条好规矩改三回,管用得多。”

他的身影在晨光里淡去:

“年轻人,我那套法,秦国用了一百多年。”

“不是因为它写得好。”

“是因为没有人敢改它。”

他的身影已经快看不见了。

可他最后又说了一句,那句话从空地那头飘过来:

“年轻人,我再送你一句。”

“先生请讲。”

你要是哪一天想改那六条,先问自己一件事。

“问什么?”

问你是发现它不对了,还是发现它对你不利了。

马可站在那儿,忽然出了一身汗。

“这两样,人分得清吗?”

那个声音已经很淡了:

分不清。所以才要五年不改。

“五年,是给你自己那点私心,留的冷却期。”


马可一个人站在空库门口。

太阳出来了。塬上的霜在阳光下开始化。

他掏出手机,把那五条打了进去。

打完他看了很久,删掉了一条,又加了一条,最后定成了六条。

删掉的那一条,本来是第四条的后半句:“如遇不可抗力,本条款另议。”

他写下这一句的时候,是职业本能。他这一行的每一份合同里都有这么一句。

可他忽然想起商鞅那句话:一条规矩,要是定它的人可以绕开它,那它就不是规矩,是他的方便。

“不可抗力另议”,那就是一扇留给自己的后门。

他删了。

加的那一条,是第六条:

“六、本库存果,先来先存,存满为止。谁的果都一样。”

他加这一条,是因为他忽然想到一个场景:等这个库真的转起来了,一定会有人来找他,说我跟马先生熟,能不能先给我留两百吨。

到那一天,这一条就是他自己的挡箭牌。

然后他做了一件事。

他给强磊打了个电话。

“马哥?”

“强磊,你现在在哪儿?”

“在家。”

“你能不能帮我办一件事?”

“你说。”

马可站在那个空库门口,看着门口那面白墙。

你去县城给我做一块牌子。

“啥牌子?”

“铁的。”马可说,“不要塑料的,不要写在纸上的。要铁的,要能钉在墙上的。”

“上面写啥?”

马可深吸了一口气。

“我把字发给你。”他说,“你找人刻,不要打印。”

“刻字贵。”

“贵也刻。”

那边沉默了一下。

“马哥,”强磊忽然问,“为啥非要刻?”

马可看着那面白墙,慢慢地说:

因为纸能撕,字撕不掉。


他挂了电话,又站了一会儿。

然后他给强东林打了一个。

响了很久才接。

“兄弟?”

“老强。”马可说,“我想跟您说一件事。”

“你说。”

马可站在那个空了三年的库门口,忽然觉得心跳得很快。

“您昨天跟强磊说,您想再存一次。”

那边沉默了。

“……那小子。”

“老强,您真想存?”

强东林那边有很长的沉默。

“想。”他最后说,“可我一个人不敢。”

马可看着门口那面白墙。

“老强,”他说,“您不用一个人。”

“怎么讲?”

“我有六条规矩。”马可说,“我要把它刻在这个库门口。”

“刻上以后,五年不改。”

那边又是很久的沉默。

然后强东林问了一个马可完全没料到的问题。

“兄弟,”他说,“那牌子上,有你的名字吗?

马可站在晨光里,忽然眼眶发热。

“有。”他说。

“在哪一行?”

马可看着那面空白的墙。

最后一行。”他说。

附录一·Dongpo's Note

Foreign friend — Gongsun Yang. You will know me as Shang Yang, and you will know how I died, so I will not pretend to give you advice from a comfortable position.

You have read the pole at the south gate as a demonstration that the state keeps its word. That is the surface. What you missed is the number.

Ten gold for carrying a pole from one gate to the other, and no man moved. Not because ten was too little for the labour — the labour was nothing, one man, half an hour. Because he would have to step out of a crowd of a thousand people in the market and carry it in full view, and if the office reneged he was the fool who had been played in front of the entire capital.

Ten gold is the price of the work. Fifty gold is the price of that risk, and it is not paid to the man who moved it. It is paid to everyone who came after him, who from that day forward needed no such price at all. The first man is always the most expensive and the price never appears in anyone's accounts.

Three conditions, since you are trying to restart a cold store. The task must be small enough that no one can claim it is impossible. The reward must be large enough to be unreasonable, because unreasonable is what gets repeated — ten gold would have been forgotten by morning; fifty was talked about for three years. And it must be paid on the spot, in front of everyone, because a payment made the next day is a story, and a payment made in the market is a thousand witnesses.

Your four thousand five hundred is a sound instinct and a bad instrument, because what they will remember is not "storage works." It is "Marco covers losses." One is a rule and survives you. The other is you, and does not.

So I will tell you how I ended, since it is the only part of my life that is any use to you. I was torn apart by chariots. Fleeing, I asked for a room at an inn on the border, and the innkeeper refused me, because the law of Lord Shang provides that an innkeeper who lodges a man without documents is punished with him. He did not recognise me. He simply applied my own statute.

The histories record my thought as "such is the harm of making laws." What I actually felt was relief. A rule its author can step around is not a rule; it is his convenience. Had that man recognised me and let me in, twenty years of work would have been nothing.

Last thing, and it is the hardest of your six. Not the first article. The fifth — that you will not change them for five years. In year one you will see the flaws; in year two someone will exploit them; in year three you will know a better way. Change them and the other five die with them, because people never remember the clause. They remember whether it holds. A poor rule kept five years outperforms a good rule revised three times. My statutes served Qin for a century, not because they were well drafted, but because no one dared touch them.


附录二·Marco's Memo

Memo to file. Village cold store, then the ruins at Yueyang. Night seventy-five.

Subject: pricing the first mover, and why my first instinct was wrong.

1. Asset status confirmed. Structurally sound, inspected by the county last year, breaker off, floor unused-clean. Five hundred tonnes against two thousand tonnes of village output. Everything works except that nobody will go in first.

2. Shang Yang's decomposition of the pole, which I had read a dozen times and never understood. Ten gold is the price of the labour, and the labour is trivial. Fifty gold is the price of stepping out of a crowd of a thousand in the public market and being visibly the man who trusted the state — with the downside that if the office reneges, he is the fool of the capital.

So the fifty is not compensation for work. It is compensation for exposure. And it is not really paid to him: it is paid on behalf of every subsequent person, none of whom will ever need it. First-mover cost is a one-time purchase of a permanent reduction in everyone else's cost, and it is capitalised nowhere.

3. Three design conditions: — Small enough that nobody can claim it cannot be done. — Unreasonably large reward, because unreasonable is what propagates. Ten gold is forgotten overnight; fifty was discussed for three years. — Paid on the spot and in public. A payment made later is a claim; a payment made in the market is a thousand witnesses.

4. My first proposal and why he cut it. Store 10,000 jin only, I advance 50% at spot on the day of deposit, upside entirely to the grower, downside on my advance not clawed back. Max loss ~4,500 yuan. He accepted the arithmetic and rejected the instrument: what the village learns is not "storage is viable," it is "Marco absorbs losses." One of those is a rule that outlives me. The other is a dependency on a man who may not come back next October.

This is the same error as my thirty-seven pages, in a new costume. I keep building things that require me to be present.

5. Revision — the same economics, restated as a posted rule rather than a personal undertaking, in six articles, ending with: this is not negotiable per person; whoever administers it applies it identically; unchanged for five years; any change announced one year in advance.

His comment: article four is the load-bearing one, because the first three are about money and the fourth is about it not being my promise. His addition: the name of the first depositor goes on the wall.

6. His own death, offered as evidence rather than confession. Torn apart by chariots after Xiaogong died. Fleeing, refused lodging under his own statute — an innkeeper may not house an undocumented man — by an innkeeper who did not recognise him. He says what he felt was relief, because a rule its author can circumvent is not a rule but his convenience, and had he been let in, twenty years would have been void.

7. His last and hardest point. The binding constraint is article five, not article one. Year one reveals the flaws, year two brings the exploiters, year three brings a better design — and amending it voids the other five, because people do not remember clauses, they remember whether it holds. A poor rule kept for five years beats a good rule revised three times. Qin ran his statutes for a century not because they were well written but because nobody dared touch them.

Actions taken at dawn. Six articles drafted. Qiang Lei commissioned to have them cut into iron in the county town — not printed, not on paper, because paper can be torn off a wall and cut characters cannot. Cost objection noted and overruled.

Qiang Donglin, on the phone, asked one question I did not anticipate: is your name on the sign. Last line, and it reads: these six articles were set by Marco. If there is a problem, come to him.

Which is what Gong Kai said last night about wet clay, and I did not expect to be applying it within twenty-four hours.


附录三·English Highlight

"Fifty gold to whoever moves it. One man moved it, and was given fifty gold at once — to make plain there was no deceit."
Shang Yang set a pole at the south gate of the Yueyang market around 356 BCE and offered ten gold to carry it to the north gate. Nobody moved. He raised it to fifty, a man carried it, and the money was paid on the spot. Only then did he promulgate the laws that would remake the state of Qin.
The standard reading is that the state was demonstrating good faith. The interesting question is the number.
Ten gold was already extravagant for the labour, which was one man and half an hour. What deterred people was not the size of the payment but the size of the exposure: the market held a thousand onlookers, and anyone who stepped out of that crowd and hauled the pole would, if the office reneged, be the fool of the capital in front of everyone he knew.
Ten gold prices the work. Fifty gold prices going first. And the fifty is not really spent on the man who moved it — it is spent on everyone who came after, none of whom ever needed such a price again.
Three conditions follow, and they generalise. The task must be small enough that nobody can call it impossible. The reward must be unreasonable, because only unreasonable gets repeated — ten gold is forgotten by morning; fifty was discussed for three years. And payment must be immediate and public, since a payment made the next day is a claim, while a payment made in the market is a thousand witnesses.
Shang Yang later fled the capital and was refused lodging at an inn under his own statute, by a keeper who did not recognise him, and was subsequently torn apart by chariots. His own verdict on that moment was not bitterness but relief: a rule its author can step around is not a rule, only his convenience.
