三月二十六日,成都,上午七点。

马可六点就醒了。

桌上是那十二条的照片,打印出来的。

旁边是一张空白的A4。

上头只写了三个字:第十三。

三个字写完,他坐了一个钟头。

他手上有三个问题。

第一个是小雷昨天晚上问的:你要是三天发不出货,怎么办。

第二个也是小雷问的:你要是收的货不对,我们照着做也是白做。

第三个是陈姐前天在电话里问的:问了你不理呢。

这三个问题他昨天晚上答不上来。

今天早上他还是答不上来。

七点十分,他先写了一句。

他写的是:

「第十三条:我要是做不到,我赔。」

写完他自己读了一遍,把这一行划掉了。

因为这一行没有数。

这是范仲淹前天晚上说的那一种。

马可靠在椅背上,看着那一行被划掉的字。

「我要是做不到,我赔。」

这一句他写的时候是真心的。

真心的东西为什么不算?

他自己想了一遍,想明白了。

因为这一句里,每一个词都归他自己解释。

「做不到」,什么算做不到?

「赔」,赔多少?

「我」,什么时候认?

三个词,三个口子。

每一个口子将来都可以从里头钻出去。

而且钻出去的时候,他还会觉得自己没有食言。

马可在那一行旁边写了一句:

「真心话是留给自己听的。」

他停了一下,写完下半句:

「给别人的那一句,要能拿去量。」

“上行出中渭桥,有一人从桥下走出,乘舆马惊。于是使骑捕,属之廷尉。释之治问。曰:‘县人来,闻跸,匿桥下。久之,以为行已过,即出,见乘舆车骑,即走耳。’释之奏当:‘此人犯跸,当罚金。’”
“上怒曰:‘此人亲惊吾马,吾马赖柔和,令他马,固不败伤我乎?而廷尉乃当之罚金!’释之曰:‘法者天子所与天下公共也。今法如此而更重之,是法不信于民也。且方其时,上使立诛之则已。今既下廷尉,廷尉,天下之平也,一倾而天下用法皆为轻重,民安所措其手足?唯陛下察之。’良久,上曰:‘廷尉当是也。’”
“其后有人盗高庙坐前玉环,捕得,文帝怒,下廷尉治。释之案律盗宗庙服御物者为奏,奏当弃市。上大怒曰:‘人之无道,乃盗先帝庙器,吾属廷尉者,欲致之族,而君以法奏之,非吾所以共承宗庙意也。’释之免冠顿首谢曰:‘法如是足也。……假令愚民取长陵一抔土,陛下何以加其法乎?’”
*English Mirror: The Emperor's procession was crossing the Middle Wei Bridge when a man came out from under it and startled the imperial horses. Riders were sent to seize him, and he was handed to the Commandant of Justice. Zhang Shizhi examined him. The man said: "I came in from the county, heard the clearing of the road, and hid under the bridge. After a long while I thought the procession had passed, so I came out — and saw the imperial carriage and riders, and ran." Zhang Shizhi's judgment was submitted: "This man violated the clearing of the road; the penalty is a fine." — The Emperor said angrily: "The man startled my horses himself. My horses happen to be gentle; had they been other horses, would he not certainly have thrown and injured me? And the Commandant of Justice sentences him to a fine!" Zhang Shizhi said: "The law is what the Son of Heaven holds in common with all under heaven. The law being as it is, to make it heavier now is to make the law not trusted by the people. Moreover, at that moment, had Your Majesty sent to have him killed on the spot, that would have been the end of it. But he has now been sent down to the Commandant of Justice, and the Commandant of Justice is the balance of the empire. Tip it once, and every application of law in the empire becomes heavy or light at will, and where are the people to put hand or foot? Let Your Majesty consider it." After a long silence the Emperor said: "The Commandant's judgment is right." — Later a man stole a jade ring from before the seat in the shrine of Emperor Gao, and was caught; Emperor Wen in anger sent him down for judgment. Zhang Shizhi, following the statute on stealing the robes and vessels of an ancestral shrine, submitted a sentence of public execution. The Emperor was furious: "The man's wickedness went so far as to steal the vessels of the former Emperor's shrine. I sent him to you meaning to have his clan exterminated, and you submit a sentence according to the statute — this is not how I mean to serve the ancestral shrine." Zhang Shizhi removed his cap, bowed his head and apologised: "By the law, this is sufficient… Suppose some foolish commoner took a single handful of earth from Changling — what law would Your Majesty then have left to add?"

上午九点,马可写了第二稿。

他写的是:

「第十三条:我要是三天之内发不出货,那一批我按二十个点照付佣金,货算我的。」

这一稿有数。

三天,二十个点。

马可算了一下这个数的分量。

一批货按四百袋算。

二十个点是一袋五块二。

四百袋,两千零八十。

四个团长,一批合起来一千五百袋上下。

要是四个人都发不出去,七千八。

他卡上六万二。

一年四批。

最坏的情况是三万一千二。

马可看着这个数,把第二稿也放下了。

不是因为赔不起。

是因为他忽然想到一件事:这一条谁来判。

三天,这个数是清楚的。

可是「收到货」是哪一天?

去年五月那一批,是下午四点到的库房。

他当天没有开箱,第二天早上开的。

这一批的三天,是从四号算,还是从五号算?

去年他自己算的时候,两种都用过。

赶的时候从五号算,不赶的时候从四号算。

没有人知道,因为没有人问。

马可把这一层写下来的时候,手停了一下。

这不是一个笔误。

这是三年里他一直在做的一件事。

遇到边界,他往对自己有利那边挪一格。

挪的时候他不觉得自己在挪。

因为那个边界本来就是他画的。

马可又想到一件事。

去年十二月他做年终那七张纸的时候,第一张上写的是「负五万八千零九十二」。

这个数他算了三遍。

三遍都一样。

可是这个数里有一笔他一直没有想清楚该不该算。

去年他自己买了一台电脑,六千八。

这台电脑一半时间在做杏干的事,一半时间在给乔总读账。

他把六千八全算进了成本。

算进去,那一年的净就更难看。

难看的数,他愿意算。

这也是往一边挪。

只不过挪的方向是往坏了挪。

马可在纸上写了一句:

「往坏了挪,也是挪。」

他停了一下,写完下半句:

「往坏了挪的时候,人觉得自己很老实。」

因为往坏了挪不用跟任何人商量。

只有往好了挪,才有人会来查。

段三·事件主体

张释之是那天上午出现的。

十点多,马可去楼下买了一份早饭,回来还是坐在那张纸前面。

屋里多了一个人。

四十来岁,中等个子,穿的是汉代的官服,颜色是黑的。

戴着一顶很正的冠。

他手里拿着一卷竹简,卷得很紧。

他先看了一眼桌上那两稿。

第一稿划掉了。

第二稿写着三天和二十个点。

他看完说的第一句是:

“第二稿比第一稿好。”

马可说:

“先生。”

那个人说:

“可是还差一半。”

他把竹简放在桌上。

他说:

“张释之。”

那天上午,张释之先说了那座桥。

他说:

“文帝出行,过中渭桥。”

他说:

“桥底下钻出来一个人,惊了皇帝的马。”

马可问:

“他是刺客?”

张释之说:

“不是。”

他说:

“是个乡下人,进城的。”

他说:

“他听见清道的声音,就躲到桥底下。”

他说:

“躲了很久,他以为走过去了。”

他说:

“出来一看,车驾就在跟前,他一慌就跑。”

马可问:

“您怎么判的?”

张释之说:

“罚金。”

他说:

“律上写的就是罚金。”

马可问:

“皇帝怎么说?”

张释之说:

“他很生气。”

他说:

“他说:这个人惊了我的马。”

他说:

“他说:我的马性子好,换一匹马,我就摔了。”

他说:

“他说:你竟然只判他罚金。”

马可问:

“这话有道理。”

张释之说:

“有道理。”

他答得很平常。

他说:

“要是那匹马烈一点,皇帝真的会摔。”

他说:

“摔了会怎么样,谁也不知道。”

他抬起头。

他说:

“可是判的是他做的那件事,不是那件事本来可能有多坏。”

那天上午,张释之说了他答的那一段。

他说:

“我说了三句。”

他说:

“第一句:法者天子所与天下公共也。”

马可问:

“这一句什么意思?”

张释之说:

“法不是皇帝的。”

他说:

“是皇帝跟天下人共有的一样东西。”

他说:

“共有的东西,一个人改不了。”

他说:

“第二句:现在律上是罚金,你要加重,那以后没有人信这本律了。”

马可点了点头。

张释之说:

“第三句最要紧。”

他说:

“我说:当时那一下,陛下要是直接叫人杀了他,就算了。”

马可停住了。

他说:

“先生,您这是说皇帝可以杀人?”

张释之说:

“当时那一下,他杀了,那是他动怒。”

他说:

“动怒是一次。”

他抬起头。

他说了一句,马可当时把笔拿起来了:

“可是他把这个人送到廷尉这儿来了。”

他说:

“廷尉是天下之平。”

他说:

“送过来以后再改,那就不是动怒了。”

他说:

“那是把秤砸了。”

马可在桌前坐着,把这一层想了一遍。

张释之说:

“一倾而天下用法皆为轻重。”

他说:

“秤歪一次,以后所有人用法,都是想轻就轻,想重就重。”

他说:

“老百姓就不知道手脚该往哪儿放了。”

马可问:

“皇帝后来怎么说?”

张释之说:

“他想了很久。”

他说:

“过了很久他说:廷尉当是也。”

马可问:

“他服了?”

张释之说:

“他没有服。”

他答得很直。

他说:

“他是认了。”

他说:

“服和认不一样。”

他说:

“服是心里同意。”

他抬起头。

他说:

“认是知道自己改不动。”

马可问了一句。

他说:

“先生,那认了以后,他恨您吗?”

张释之说:

“不恨。”

他说:

“他后来还提拔我。”

他说:

“我做廷尉做到他死。”

马可问:

“为什么?”

张释之说:

“因为他知道我那天没有跟他争。”

马可说:

“您那天说了三段。”

张释之说:

“我说的是律。”

他说:

“我一句也没有说他不对。”

他抬起头。

他说:

“我要是说了一句「陛下不该动怒」,那就是我跟他两个人的事了。”

他说了一句,马可当天在本子上抄了三遍:

“说律,那是他跟天下的事。”

他说:

“跟天下的事,他认了不丢人。”

他说:

“跟我一个人的事,他认了就是输给我。”

他说:

“输给我的那一次,他一辈子记着。”

那天上午,张释之说了马可那一条差在哪儿。

他用手指点了第二稿。

他说:

“三天,二十个点,这两个数是好的。”

他说:

“差的是那一句没有写的:谁说你没做到。”

马可说:

“这个明摆着。”

他说:

“几号收货几号发货,都有单号。”

张释之说:

“单号是证据。”

他说:

“证据不是判。”

他把那卷竹简往前推了一寸。

他说:

“总有说不清的时候。”

他说:

“第三天下午发的,路上堵了两天。”

他说:

“收货那天下午到的,你第二天早上才拆箱。”

他说:

“这些算三天里头还是外头?”

马可说:

“这个可以再写细。”

张释之说:

“写不细。”

他说得很干脆。

他说:

“写一百条,还有第一百零一种。”

他抬起头。

他说了一句,马可当天在本子上抄了四遍:

“写不细的地方,不是靠写,是靠交给谁。”

马可问了最后一句。

他说:

“先生,交给谁?”

张释之说:

“不能是你。”

他说:

“你写的条,你判自己,那还是你一个人的条。”

马可说:

“我打算写:陈姐说了算。”

张释之说:

“好。”

他站起来。

他说:

“那还有一样。”

马可问:

“哪一样?”

张释之说:

“她判你赔,你当天不能问为什么。”

马可说:

“问一句也不行?”

张释之说:

“问一句就是重来一次。”

他说:

“你可以过后跟她说这条该改。”

他说了走之前那一句:

“可是这一批,先赔。”

他走到门口,又回过头。

他说:

“还有一件事,我说完就走。”

马可说:

“先生请说。”

张释之说:

“后来有人偷了高庙里的一个玉环。”

他说:

“抓住了,皇帝很生气,交给我。”

马可问:

“您判的什么?”

张释之说:

“弃市。”

他说:

“律上偷宗庙器物就是弃市。”

马可问:

“皇帝呢?”

张释之说:

“他要灭族。”

他说:

“他说我交给你,是要灭他的族,你却按律来奏。”

马可问:

“您怎么答的?”

张释之说:

“我把帽子摘了,磕头。”

他说:

“我说:按律,这样就够了。”

他说:

“然后我问了他一句。”

马可问:

“问的什么?”

张释之说:

“我说:要是有一天,有个蠢百姓从长陵上挖了一捧土。”

他停了一下。

他说了那半句,说完就不见了:

“陛下拿什么罪加给他?”

马可站在屋里,把这一句想了很久。

偷玉环就灭族,那挖一捧土的怎么办?

最重的那一档要是用早了,后面就没有了。

他把这一层写在纸上,写完想起自己那第十三条。

他那五句里,最重的一句是「货算我的」。

这一句用在「三天没发出」上。

要是有一天他做了更坏的事呢?

比如说,他明知道货有问题还发出去了。

那一条他没有写。

因为他不敢想自己会做那件事。

段四·钩子结尾

那天下午两点,第十三条定稿。

一共四句。

第一句:我收到货三天内发出。发不出的,那一批佣金二十个点我照付,货算我的。

第二句:我收的货要是有问题,那一批你们卖出去的,退款我出,佣金我照付。

第三句:我三天内不答陈姐的话,算我没做到。

第四句:以上三条,是不是没做到,陈姐说了算。她说了,那一批当天算数,我事后可以说这一条该改,改的是下一批。

马可写完,把这四句念了两遍。

第二遍念到第四句的时候,他停了一下。

「她说了,那一批当天算数。」

这一句写下去,就没有回头路了。

他把这一句留着,先去算了一笔账。

那笔账他算了四十分钟。

最坏的一年是这样的。

四批货,每批四个团长合起来一千五百袋。

四批全部发不出去或者货有问题。

佣金照付:一千五百乘四乘五块二,三万一千二。

退款全出:按去年七点九算,四百七十四笔,一千四百二十。

货算他的:进价一千五百乘四乘七块五,四万五。

加起来七万七千六。

卡上六万二。

赔不起。

马可看着这个数,坐了很久。

然后他做了一件事。

他没有改那四句。

他在下面加了第五句:

「以上要是赔不出来,我把这一年剩下的钱全给出去,给完了我告诉你们还差多少,欠着。」

加完他又念了一遍。

这一句里没有数。

他知道范仲淹会说这一句不算。

可是他写不出别的。

因为他手上就这么多钱。

他把第五句改了一次,改成了:

改之前他先算了一件事。

六万二这个数,写出去以后收不回来。

他在纽约那些年,见过太多这种数。

一家公司的现金余额一旦让外头知道,后面所有的谈判都变了。

供应商知道你只剩三个月,账期就不给了。

客户知道你只剩三个月,付款就慢了。

这是常识。

他自己给别人做过这样的分析,做过不止一次。

今天下午,他要把这个数主动写给四个人。

马可在纸上写了一句:

「我知道这一步是错的。」

他停了一下,写完下半句:

「可是那十二条要立得住,只能用这一步立。」

「我现在卡上六万二千块。上面三条最坏一年要七万七千六。差一万五千六,我今天就告诉你们。」

这一句他写完读了四遍。

第一遍读,觉得很硬气。

第二遍读,开始不舒服。

第三遍他知道不舒服在哪儿了。

这一句里,他把自己的底摊给了四个人。

四个人里,有三个是他去年才勉强算得上熟的。

他们知道了以后会怎么样?

第一种:更信他。

第二种:开始担心他,担心到不敢跟他做。

第三种:拿这个数去算他撑不撑得到七月。

第四遍读的时候,马可想的是范仲淹那一句。

一本册子里,第一个被它挡住的人,得是写它的那个人。

挡住的意思,不只是罚。

挡住的意思是:这一条会让写它的人不舒服。

要是写完很舒服,那就还没写到。

马可把这一句留下了。

下午四点半,马可把第十三条发出去了。

还是照片。

发出去以后他把手机扣在桌上,去洗了个澡。

出来的时候有三条回复。

陈姐:「收到。第四句我看了三遍。」

郭老师:「你这个是不是太狠了。」

马可给郭老师回了一句:「不狠。」

郭老师又发过来一条:「你一个人做这么大的生意,出点事很正常。」

马可看着「这么大的生意」这五个字,笑了一下。

去年一年两千四百一十袋。

这不是一个大生意。

可是在郭老师那儿,它是大的。

因为她只看得见她自己那四百一十袋。

王姐:「行。」

小雷是七点多回的。

这一次不是语音,是打的字。

第一条:「第十三条我不同意。」

马可看着这五个字,等下一条。

下一条来了:

「不是嫌你写得少。」

再下一条:

「是你赔不起。」

小雷后面那几条发得很快。

他说:

「你把六万二写上去,我看见了。」

他说:

「你写这个数是为了让我们信你。」

他说:

「我信了。」

他说:

「可是我信完以后,我在算另外一件事。」

马可打了一句:

「您算什么?」

小雷回:

「我算你今年五月那一批,能不能发出来。」

下面一条:

「你六万二,一年花十万。」

再下面一条:

「五月收货要给钱吧?」

再下面一条:

「去年五月你收了六百二十袋,那是我一个人的。」

再下面一条:

「今年四个团加起来,五月你得收一千五百袋往上。」

马可看着这几条,知道小雷算过了。

而且算得比他预料的细。

小雷手上没有他的成本表。

小雷只知道零售二十六,佣金二十个点。

可是小雷卖了三年货。

卖了三年的人,心里有一本自己的账。

再下面一条:

「你拿什么给?」

马可坐在桌前,没有立刻回。

这几个问题他自己每天都在算。

五月吐鲁番那一批,收货款按去年算三万四。

加上运费和袋子,四万一。

发出去以后,钱要到七月才回得来。

这中间是两个月。

卡上六万二,扣掉四万一,剩两万一。

两万一撑两个月,房租吃饭加上库车那边说好的事,撑不到七月。

这个缺口他一直没有跟任何人说过。

今天下午他在第十三条里写了六万二这个数。

写的时候他想的是「让人信我」。

他没有想到,写出来以后,别人会拿这个数去算他的下一步。

小雷又发了一条。

这一条发完,隔了很久也没有下一条:

「马可,你把那六万二写出来,是好事。」

「可是你只写了一个数。」

「你要是真按你自己那十三条办,你该把整张表给我们看。」

马可把手机放下。

他去阳台站了一会儿。

成都三月底的晚上,还有一点凉。

楼下有人在遛狗。

他想的是一件很具体的事:整张表是什么。

他自己那七张纸,去年年底捆起来放在抽屉里。

第一张是数。

第一张上有收购价,有袋子钱,有运费,有团长那五块二,有他自己那十块七毛五。

十块七毛五这个数,四个团长里没有一个知道。

他们知道零售二十六。

他们知道自己拿五块二。

他们不知道剩下那二十块八毛,是怎么分的。

这个数一直没有说,不是因为见不得人。

是因为他从来没有想过要说。

做买卖的人不跟渠道说自己的毛利,这是天经地义。

马可在阳台上站着,想到「渠道」这两个字。

去年十月罗代办在兰州街上说过:渠道是会比价的,人不会。

他那时候点头点得很快。

今天晚上他知道,那句话他还没有做完。

因为对人和对渠道的区别,不在态度上。

苏东坡当夜记下的:这一回他看见了什么

Twenty-sixth of March, awake at six. On the table: the twelve clauses printed out, and one blank A4 with three characters on it — clause thirteen — and then an hour of sitting.

Three questions I could not answer last night and could not answer this morning. Xiao Lei: what happens if you can't ship in three days. Xiao Lei: what happens if the goods you bought are wrong — we do everything right and it's still wasted. Chen, on the phone the day before: what if I ask and you ignore me.

Seven ten. First attempt: clause thirteen: if I fail to do these things, I pay. Read it back and struck it out. No number in it. Fan Zhongyan's category exactly.

Nine o'clock, second attempt, with numbers: if I cannot despatch within three days of receiving goods, I pay that run's commission at 20% anyway and the goods are mine. Priced it: a run of 400 bags at ¥5.20 = ¥2,080; four leaders is about 1,500 bags a run, ¥7,800 if all four fail; four runs a year, worst case ¥31,200 against ¥62,000 in the bank. Put it down — not because I can't afford it, but because I suddenly saw that the clause does not say who decides whether I failed.

Zhang Shizhi came at ten — forty-odd, middling height, black Han official's robes, a very correct cap, a tightly rolled bundle of slips. He read both drafts. The second is better than the first. Sir. But it is still half missing. And, setting the slips down: Zhang Shizhi.

The bridge: the Emperor's procession was crossing the Middle Wei Bridge and a man came out from under it and startled the horses. An assassin? No. A countryman coming into town. He heard the road being cleared and hid under the bridge. After a long time he thought they had gone past. He came out, saw the carriage right there, and bolted. And your judgment? A fine. The statute says a fine.

The Emperor's objection: the man startled my horses. My horses happen to be gentle; other horses would have thrown me. And you sentence him to a fine. I said that sounds reasonable. It is reasonable. Evenly. With a hotter horse the Emperor really would have come off, and nobody knows what that would have led to. And: but what is judged is the thing he did, not how bad that thing might have turned out.

His three sentences. First: the law is what the Son of Heaven holds in common with all under heaven. Meaning? The law is not the Emperor's. It is a thing he holds jointly with everyone. A thing held jointly, one man cannot alter. Second: the statute says a fine; make it heavier now and nobody will trust the statute again. And the third matters most. Which was? I said: at that moment, had Your Majesty ordered him killed on the spot, that would have been the end of it. I said that sounds like licensing an emperor to kill. At that moment, killing him is anger. Anger is once. And, and I picked up the pen: but he sent the man here, to me. The Commandant of Justice is the balance of the empire. And: to change it after it has come here is not anger any more. That is smashing the scales. And: tip it once, and every application of law in the empire becomes heavy or light at will, and the people do not know where to put hand or foot. What did the Emperor say? After a long silence: the Commandant's judgment is right. He accepted it? He did not accept it. Flat. He conceded it. Accepting and conceding are not the same. Accepting is agreeing in your heart. Conceding is knowing you cannot move it.

On my draft, finger on it: three days and twenty percent are good numbers. What is missing is the sentence you have not written: who says you failed. I said it's obvious — there are tracking numbers for everything. A tracking number is evidence. Evidence is not judgment. Pushing the slips forward an inch: there will always be unclear cases. Despatched on the afternoon of the third day and stuck two days in transit. Delivered on an afternoon and you opened the carton the next morning. Are those inside three days or outside? I said I could write it more finely. You cannot. Immediately. Write a hundred clauses and there will be a hundred and first. And, four times into the book: what cannot be written finely is not solved by writing. It is solved by whom you hand it to.

To whom? Not to you. Your clause, judged by you, is still your clause alone. I said I meant to write: Chen decides. Good. Standing: then one more thing. On the day she rules against you, you may not ask why. Not even once? Asking once is doing it again. And: you may say afterwards that the clause should be changed. And, going: but for that run, you pay first. — M.

分析师的复盘:数字、结论、他改了哪条规矩

Memo to file. Chengdu, 26 March 2031. Clause thirteen — the one that governs me.

1. Final text, four sentences plus a fifth I added after doing the arithmetic. (1) Despatch within 3 days of receipt; failing that, that run's 20% commission is paid anyway and the goods are mine. (2) If the goods I bought are faulty, refunds on that run are mine and commission is paid in full. (3) If I do not answer Chen within 3 days, I have failed. (4) Whether I have failed is decided by Chen. Her ruling stands for that run on the day. I may argue afterwards that the clause should change — the change applies to the next run. (5) I have ¥62,000 in the bank. Worst case under the three clauses above is ¥77,600 a year. I am ¥15,600 short and I am telling you today.

2. Why (4) is the whole clause. My instinct was that failure is self-evident — every despatch has a tracking number. Zhang Shizhi: a tracking number is evidence; evidence is not judgment. And the unclear cases are not marginal, they are constant: despatched on the third afternoon and stuck in transit; delivered at four and opened at nine the next morning. Write a hundred clauses and there is a hundred and first. What cannot be written finely is not solved by writing. It is solved by whom you hand it to.

3. And the part I would not have thought of: no appeal on the day. On the day she rules against you, you may not ask why. Asking once is doing it again. You may say afterwards that the clause should be changed — but for that run, you pay first. This is the bridge case exactly. The Emperor's anger was legitimate and his reasoning was sound — with a hotter horse he would have been thrown — and the answer was not that he was wrong but that he had already handed it over. Anger is once. Reopening it after handing it over is not anger, it is smashing the scales. *And Zhang Shizhi's distinction, which I want to keep because I will need it: the Emperor did not accept the judgment. He conceded it. Accepting is agreeing in your heart; conceding is knowing you cannot move it. I will be conceding, not accepting, and the clause has to work in that state.

4. The arithmetic, worst case, one year. Commission paid on undelivered goods: 1,500 × 4 × ¥5.20 = ¥31,200. Refunds fully absorbed at last year's 7.9%: ¥1,420. Goods written off at cost: 1,500 × 4 × ¥7.50 = ¥45,000. Total ¥77,600 against ¥62,000. I cannot cover it. I did not soften the clause. I wrote the shortfall into it.

5. What that disclosure did, which I did not anticipate. I wrote ¥62,000 into a rules document in order to be believed. Chen: received; I read sentence four three times. Guo: isn't this too hard on yourself. Wang: fine. Xiao Lei, 7 p.m., typed rather than voice: "I don't agree with clause thirteen." And: "Not because it's too little." And: "It's that you can't afford it." *Then he used the number I had given him to compute my next move, which is what a number is for and which had not occurred to me while I was writing it: "Sixty-two thousand, spending a hundred a year. You have to pay for the May lot on collection, don't you? What are you going to pay with?" The May position, which I have not told anybody: goods ¥34,000, plus freight and bags ¥7,000 ≈ ¥41,000 out in May, nothing back until July. 62,000 − 41,000 = 21,000 to live on for two months, with commitments in Kucha. It does not reach July.

6. And his last message, which is the correct criticism and I have no answer to it tonight. "Putting the sixty-two thousand out there is a good thing." "But you only wrote one number." "If you're really going to run by your own thirteen clauses, you should show us the whole table." I published the single figure that made me look candid and withheld the eleven that make me look precarious. Clause 13 says Chen judges whether I have complied. It says nothing about whether the disclosure I chose to make was the disclosure that mattered — and Xiao Lei found that gap in about two hours.*

The case was trivial. A countryman coming into the capital heard the road being cleared for the imperial procession, hid under a bridge, waited what he judged long enough, came out into the middle of the carriages and horses and ran. The statute prescribed a fine, and a fine was what the court awarded.
The Emperor's objection was not stupid and the judge did not pretend it was. The man startled my horses. My horses happen to be gentle; other horses would have thrown me. Asked whether that was reasonable, the judge said it was: with a hotter horse the Emperor really would have come off, and nobody knows what that would have led to. And then the distinction the case turns on: what is judged is the thing he did, not how bad that thing might have turned out.
His argument had three parts. The law is what the Son of Heaven holds in common with all under heaven — not the ruler's property, and therefore not alterable by one man. The statute says a fine; make it heavier now and nobody will trust the statute again. And then the concession that makes the whole speech serious rather than pious:
At that moment, had Your Majesty ordered him killed on the spot, that would have been the end of it.
He was not defending the man. He was drawing a line in time. Killing him at that moment is anger, and anger is once. But he sent the man here, to me. Once a matter has been handed to the balance, taking it back is not anger any more. That is smashing the scales.
After a long silence the Emperor said the judgment was right — and the judge, recalling it, refused the flattering reading. He did not accept it. He conceded it. Accepting is agreeing in your heart. Conceding is knowing you cannot move it.
A rule written by the person it will one day be used against needs both halves. The number is the easy half. The other half is the sentence nobody wants to write, and it was given as an instruction rather than an argument: on the day she rules against you, you may not ask why. Asking once is doing it again. You may say afterwards that the clause should be changed — but for that run, you pay first.
