English Mirror: From here on lies the Gashun Gobi, more than eight hundred li across, called in old times the River of Sand: no bird flies above it, no beast runs on it, and there is neither water nor grass. — Both parties having agreed together, the joints of the finger are marked as the seal.
Dongpo's Note
Eight o'clock, four sheets on the low table, Abdul Rahman on the east side, me on the west, Alim standing with the phone on speaker and Luo on the other end through a bad line.
An hour and a half to read them through. At clause four of the ledger — what cannot be settled is written "unsettled," and nobody chases it — he stopped me. Who is this clause for? For me; I amended it in March so it binds me only as creditor. And if I owe you? Then you needn't repay either. No. Flat. Write it down: if I owe you, you chase me. Why? And I wrote his answer into the clause on the spot: if you don't chase me, I have to raise it myself.
The five exit clauses went fast; nobody disputed them. One word changed, on clause five, which read: on separation each states their own reasons and neither states the other's shortcomings. Add a "not." Where? Each states neither the other's shortcomings nor his own merits. Why? Go round afterwards saying how well you did it and people know it was me who didn't. Rewritten: on separation both parties say only that it did not suit, and nothing else.
The cost roll. You're publishing this? Yes. It has my price to you on it. I'm not printing yours; I'll leave a gap: origin price — set by the producer, not disclosed. A gap looks bad. — A gap is honest. Filling it in for you is clever. He laughed: that isn't yours. No; a fruit-seller outside the museum. He did not ask which. Fine. Leave the gap. Then: but finish the line. Write: I know this figure and I promised him I wouldn't print it.
Then the fourth sheet, four clauses, and at the last one — whether or not Party B is present — the phone went quiet. Luo? Here. Go on, I'm listening. That's the end of it.
A few seconds, and then: is Rahman there? Yes. Do you accept my guarantee? — I do, instantly, with no thought at all. You're not going to ask how much money I have? No. And, hand flat on the table: if you had money you wouldn't have spent thirty years standing at my gate.
Ten o'clock, thumbprints. Alim had gone into town for the red paste at four yuan a box. Abdul Rahman first, under Party A. Mine second, under Party B, and my hand shook and it smeared. Do another. The second one is clean; the two sit side by side. The third column is blank; Luo is in Zhangye. Post it to me. I'll press it and post it back. And: use registered mail, not a courier. Why? A courier gives you a tracking number. Registered gives you a return receipt. A tracking number is something you look up. A receipt is something that comes back.
Then the old half, out of the notebook and onto the back of the new sheet. Why the back? Because giving it to you makes your household owe his, and giving it to him — it is your family's. Stuck here, nobody has to take it away. He turned the sheet over and back several times: front, 19 July 2028; reverse, autumn 1976. A long look, and then: use paste. Not tape. Why? Tape goes brittle in twenty years.
Xuanzang was across the table at noon while the others ate, in the same worn robe as at Korla on 7 November, at the Jade Gate on the sixteenth, and in the doorway of house two on the twenty-second. Nine months. Nine months.
He did not touch the paper. What did I say to you in Korla? That what I built in Luochuan depended on there being somewhere that could punish me, and that west of the pass there is no punishing. Nine months. What's your answer now?
*I said the true thing first: I haven't solved it. Nothing on that sheet can be enforced. If he withholds goods I cannot sue him; if I stop coming he cannot sue me; Luo's guarantee, if it is ever called, is honoured because he honours it. Then why write it?
So I gave him the six. A fine must be payable — three sheng of wine — because a fine that cannot be paid removes the man. A ledger exists so that on the day he can repay he need not speak. A guarantor exists so that a third person is present and "there's no such thing" cannot be said. A ten-day acknowledgement exists not for its content but so you know he is still there. Exit terms are written first so that two people dare begin. And what you do not know goes on the label so that discovering it is not discovering a concealment. Not one of the six is a punishment. All six make the first step at the door cheaper.
He was quiet a long time. Then: you have it backwards. Where? You said: make keeping the agreement cheap. That isn't hard. And then the line I copied five times: what is hard is making speaking cheap.
And he took my own six and turned each one over. The wine fine, so that a man who has been fined can still sit down. The ledger, so he need not explain. The guarantor, so the two of them can open their mouths at all. The ten-day note, so he opens his mouth every ten days and can therefore open it on the day something goes wrong. The divorce formula, so there is something to say on the day it ends. Writing down what you don't know, so he can ask.
Every broken thing you have seen on this road — not one of them broke because somebody refused. They broke because somebody could not open their mouth. — M.*
Marco's Memo
Memo to file. Turpan, 19 July 2028. Nine months from Korla. This block closes.
1. Executed today. Four sheets — ledger (6 clauses), exit terms (5), cost roll (6 lines), and the underwriting (4 clauses) — read aloud in full over ninety minutes with all parties present, two by thumbprint and one by speaker-phone. Third print to follow by registered post.
2. Three amendments made by the counterparty, all of which improved the document, and all against his own interest. (i) Ledger clause 4 made reciprocal against him: I had written it to bind me only as creditor (ch.139, after Shang Yang's inn door). He required the opposite: if I owe you, you chase me — because if you don't chase me, I have to raise it myself, which is the whole of ch.129 stated by a man who has never met Chang. (ii) Exit clause 5 extended: neither party states the other's shortcomings nor their own merits — because praising yourself afterwards identifies the other as the failure. I had closed one channel of blame and left the second open. (iii) The gap in the cost roll annotated: not merely "not disclosed" but "I know this figure and I promised him I would not print it." — A gap says nothing was known. An annotated gap says something was known and withheld, and by whom, and why. Strictly better, and I would not have thought of it.
3. Registered post, not courier. A tracking number is something you look up. A return receipt is something that comes back. Which is An Yuanjin's circular exactly (ch.131: the notice goes the round and returns to the office; if it does not come back, something has happened) and the ch.138 finding that my own instrument's value lay in its return leg. Luo supplied it in four words without knowing any of that.
4. The half tally: pasted to the reverse of the new sheet. Not surrendered to either family, because handing it to Rahman creates a debt from his household to Luo's, and handing it to Luo returns a thing that is not his. Front: 19 July 2028. Reverse: autumn 1976. And: paste, not tape — tape goes brittle in twenty years.
5. Xuanzang's question, put on the first night in Korla and answered today: west of the pass there is no punishing. My answer, and I gave the honest half first: it is not solved. Nothing in the document is enforceable. What replaces enforcement is six devices, and not one of them is a penalty: — a fine sized to be payable (ch.131), so that being fined does not remove you; — a written record (ch.130), so that performing does not require a speech; — a third name on the paper (ch.149), so that "there is no such thing" cannot be said; — a ten-day acknowledgement (ch.148), content irrelevant; — exit terms written before entry (ch.135), so that beginning is survivable; — disclosure of what is not known (ch.147), so that discovery is not exposure.
6. And his correction, which is the finding of the whole nine months and which I did not have until noon today. I said: the six make keeping the agreement cheap. That isn't hard. What is hard is making speaking cheap. Each device, turned over: the wine fine lets a fined man sit back down. The ledger lets a debtor set the grain down without explaining. The guarantor lets two men open their mouths at all. The ten-day note is practice at opening your mouth, so that it opens on the day it matters. The exit formula supplies something to say on the last day. Written ignorance makes it possible to ask. Every failure on this route failed for the same reason, and it is not unwillingness. Chang: how would I open my mouth in the third year. Luo: go in and say what. Abdul Rahman: I saw him, and I didn't know what to say either. Miwnay: it was written and nobody received it. Alim: because nobody looked. Xiao Lei: two years recruiting and people are all I have left. Jiang: if I said it, it would be me asking you. Seven people. Not one of them refused. All seven could not open their mouths. Which reclassifies everything I have built this year. I thought I was building trust infrastructure. I was building openings.
7. The half tally, finally explained. In Korla: this is not for you; it is for you and one other person. I spent nine months assuming the other person held the matching half, and today the matching half is pasted to the back of a contract and the answer is still no. What is a half tally? A record of something true, with nobody to match it against. Which is every unread ledger I have met this year: — Qin, Jiayuguan: thirty-odd notebooks of his own breakage rates. Consulted by nobody but Qin. — The gift ledger, Dunhuang: sixteen years, 87 households. Read only at funerals. — Chang, 2003: twice-daily weights, 126 days, on a question he never solved. — Alim, 2022: 63 pages of full traceability, abandoned for want of a reader, saved from under a table leg. An unread ledger is half a tally. It is waiting for the other half. And of the four, two have now been matched: Chang's fifty thousand is entered in a ledger at his own request (ch.140), and Alim's record has a named reader as of this morning. Two remain.
8. What I actually am, stated for the first time without embellishment. Not a trader. Not a broker — I declined that position twice this week and would decline it again. I am the second half of other people's ledgers. It is the only thing I have done in nine months that nobody else on this chain was positioned to do, and it required no capital, no goods and no trucks. It required having stood in both places and being willing to read.
9. Given to Alim at the car: a blank blue exercise book, ¥2.50, identical to his 2022 one, with three lines written on the first page. — Drying houses two, three and nine. — Begun 2028. — Reader: Marco. Chengdu. With an address and a telephone number. He did not thank me. He said: and if you stop reading it? — Then tear that page out.
10. Next. Chengdu. And before anything else: telephone Qin in Jiayuguan. Thirty years of counted breakage rates in thirty-odd notebooks, which he keeps for himself, and which no customer of his has ever asked to see. I do not know what it is worth. I know that it is a half.
English Highlight
"From here on lies the Gashun Gobi, more than eight hundred li across: no bird flies above it, no beast runs on it, and there is neither water nor grass."
The question had been put nine months earlier, on the first night, and it was a hard one. Everything you built in that eastern county depended on there being somewhere that could punish you. West of the pass there is no punishing.
The answer, when it came, began by conceding the point. Nothing on the sheet was enforceable. If the producer withheld goods there was no suing him; if the buyer stopped coming there was no suing him either; and the guarantee, if it were ever called upon, would be honoured only because the guarantor chose to honour it.
What stood in place of enforcement was six things, and not one of them was a penalty. A fine small enough to be paid on the spot — three sheng of wine — because a fine a man cannot pay does not punish him, it removes him. A written record, so that a debtor who finally has the money can set it down without having to account for the intervening years. A third name on the contract, so that the sentence there's no such thing cannot be said. A note every ten days whose content does not matter. Terms of separation written before the terms of the work. And a printed admission, on the goods themselves, of what the seller does not know.
All six, the argument went, exist to make keeping the agreement cheap.
You have it backwards. Making keeping it cheap is not hard. What is hard is making speaking cheap.
And each of the six, turned over, is the same device. The wine fine leaves a man able to sit back down. The ledger removes the need for a speech. The guarantor gives two people who cannot address each other a third person to address. The ten-day note is practice, so that a mouth that opens routinely can open on the one day it must. The parting formula supplies something to say on the last day. And writing down an ignorance is what allows the other party to ask about it.
Not one thing that broke on that road broke because somebody refused. They broke because somebody could not open their mouth.
A man who could not repay fifty thousand yuan for ten years, not from poverty but because by the third year paying had become a confession. A man who stood at a gate once a year for thirty years and never went in, because he could not compose a first sentence. The man on the other side of the gate, who saw him every year and did not know what to say either. A woman whose letter was written and never received. A grower who kept a perfect record for one season and stopped, because nobody looked at it.
