十二月十六日,早上九点。
洛川,村委会会议室。
四个人。
组长姓卢,四十七八,厅纪检组。
一个计财处的,三十来岁。
一个审计厅的,五十上下,一直不说话。
还有一个记录的,很年轻。
桌上摆着两摞材料。
左边那一摞,是他们带来的。
右边那一摞,是马可十二月五日送上去的,加上强磊那五条。
卢组长开的头。
“马先生,我们这次来,三天。”
“好。”
“第一天看东西,第二天谈话,第三天反馈。”
他把一个笔记本翻开。
“开始之前,我说三句。”
“第一,我们不是来定你有罪没罪的。我们是来核实三件事是不是发生过。”
“第二,你可以不回答任何问题,我们会如实记录『不予回答』。”
“第三,”
他抬起头。
“你送上来那份东西,我们看了。”
他停了一下。
“第八条,是你自己加的?”
“是。”
卢组长在本子上写了一行。
他没有说好,也没有说不好。
过了几秒,卢组长又问了一句。
“为什么在我们来之前送?”
马可想了一下。
他有一个漂亮的答法。
他也有一个真答法。
他用了真的那个。
“因为你们迟早会查到。”
他停了一下。
“你们查到以后再问我,我就没法答了。”
卢组长看了他一眼。
他没有再写。
过了一会儿,他把笔放下了。
“马先生,我在纪检组九年。”
“是。”
“我问过大概两百个人这个问题。”
马可抬起头。
“他们都怎么答?”
卢组长把笔重新拿起来。
“一百九十几个人说:我认为有必要主动说明情况。”
他在本子上写了一行。
这一行马可看见了。
他写的是:
「问:为何提前报送。答:你们迟早会查到。」
写完,他抬起头。
“马先生,还有一件事,我先跟你交代。”
“您说。”
“这三天,我们会跟七八个人谈话。”
他把笔帽扣上。
“谈话的时候,你不在场。”
“我知道。”
“还有一条,你可能不知道。”
卢组长看着他。
“这三天里,你不要跟他们对口径。”
马可点了点头。
“我不会。”
卢组长摇了摇头。
“你别急着答应。”
“为什么?”
他说了一句很实在的话:
“因为对口径这件事,多数人不是故意的。”
“那是什么?”
卢组长把笔记本合上。
“是一个人晚上睡不着,跑去问另一个人:他们今天问你什么了。”
他停了一下。
“这一句就是对口径。”
马可在心里过了一遍。
他知道自己今天晚上会想问强磊。
“卢组长,那我要是想问呢?”
卢组长站起来。
“你就记着一件事:”
他把材料抱起来。
“你问了,他答了,你们两个人的话就都不算数了。”

那三天,是这样过的。
第一天,他们看东西。
上午看台账。
两本,一本原件,一本复印件。
每一页右下角有页码,三十五分之一到三十五分之三十五。
审计厅那位看得最慢。
他一页一页翻,翻到第三十五页,停住了。
那一页是空的。
上面只印着一行小字:本页归记录人。
“这一页为什么是空的?”
强磊答:
“因为我到今天,没有觉得哪儿不对。”
审计厅那位没有再问。
他在自己本子上,把这一页的页码抄了下来。
下午看那面墙。
卢组长在墙前面站了很久。
他一样一样问。
“这六条铁牌,谁定的?”
“我。”
“谁刻的?”
“县上一家做门牌的,二〇二五年十月,四百二十块,有收据。”
“这四页纸是什么?”
“是我自己的来路。”
“什么来路?”
马可答得很平。
“二〇一八年,我在纽约那家基金,做过一份报告。那份报告里有一个数是真的,可我没写那个数买的是什么。二〇二五年十一月,我把这件事写成四页,钉在这儿。”
卢组长看着他。
“这件事,有人查过你吗?”
“没有。”
“那你为什么写?”
马可站在那面墙前面。
他想了几秒钟。
然后他说:
“因为我要让七户人家把果放进这个库。”
卢组长没有再往下问。
他转身看了一眼那张空白A4。
上面有一行小字,和一段很小的圆珠笔字。
他把那一段念了出来。
“这个库,从一开始就不该建在这儿。二〇二二年二月我就这么想过,没跟第二个人说。王志远。二〇二六年八月九日。”
念完,会议室里安静了几秒。
卢组长转过身,问了一句:
“王志远是谁?”
“合作社法人。这个库二〇二一年立项,五个签字的人之一。”
卢组长在本子上写了三个字。
马可看见了。
他写的是:王志远。
段三·事件主体
第二天是谈话。
一个一个进那间会议室。
强东林。四十分钟。
李叔。五十分钟。
刘忠民。二十分钟。
王主任。一小时四十分钟。
强磊。两个小时零十分钟。
马可在外面院子里等。
那天很冷。
零下八度。
他等了六个多小时。
中间李叔出来的时候,冲他点了点头。
刘忠民出来的时候,走过来说了一句:
“马先生,那个争议堆,我跟他们讲了。”
“您讲的什么?”
刘忠民说:
“我说,我那三筐,少得九块九。”
“还说什么了?”
他想了一下。
“我说,那个本子上有一栏空着,说是二月填。”
他停了一下。
“他们问我信不信。”
“您怎么答的?”
刘忠民搓了搓手。
“我说我不知道信不信。”
他抬起头。
“我说我签了字。”
下午四点,王主任从那间屋子里出来。
一小时四十分钟。
他出来的时候,脸是白的。
马可想上去说句话。
王主任摆了摆手。
他没有停,直接从院子里穿过去了。
马可站在雪地上,看着他的背影。
他忽然想起一件事。
这个人从二〇二一年到今天,一共在这个项目上出现过几次?
立项,签字。
验收,签字。
二〇二二年二月吵架那天,在场。
断电那四个小时,三把钥匙里有一把是他的。
去年十月,一秒算出四万五。
去年十二月,两次问「明年那块木板写谁」。
今年一月四日,把四页纸报到省厅。
二月十九日,劝马可签第八条。
八月九日,在一张空白纸上写了那三行。
九次。
没有一次是他主动来找马可的。
每一次都是马可在的时候,他正好也在。
或者,是马可不在的时候,他一个人来。
那天晚上八点,马可一个人在库房里。
压缩机在响。
库里现在存着四十一吨。
徐有功是在库门口出现的。
五十来岁,一身绿色的官服,很旧。
个子不高,很瘦。
他手里拿着一卷东西,是律文。
“徐公。”
“马先生。”
他在库门口那张塑料椅上坐下。
“明天他们要给你结论。”
“是。”
“你今夜在想什么?”
马可老实说:
“我在想,我该不该跟卢组长讲一讲,我为什么要做这些事。”
徐有功摇了摇头。
他摇得很干脆。
“不要讲。”
“为什么?”
徐有功把那卷律文放在膝盖上。
“马先生,你讲你为什么,他就得判你为什么。”
他抬起头。
“这件事,从有没有,变成了值不值。”
“这不好吗?”
“不好。”
徐有功说,“有没有,是可以查的。值不值,查不了。”
他把手放在那卷律文上。
“查不了的事,最后是屋里那个人心情说了算。”
马可坐在那儿,很久没有说话。
过了一会儿,他问了一句:
“徐公,我读过您的传。”
“你读到什么?”
“您在武后朝做大理丞。”
“是。”
“三次被判死。”
徐有功点了点头。
“头一次,是为一个姓庞的妇人。”
“窦孝谌的妻子。”
“你还知道这个。”
马可说:
“告她的罪名是巫蛊。”
徐有功笑了一下。
“那个罪名好用。”
“为什么好用?”
“因为它不用物证。”
他把那卷律文展开了一点。
“马先生,你那封信上三段,最难办的是哪一段?”
马可想了一下。
“第一段。”
“为什么?”
“因为第二段和第三段,都能查。第一段查不了。”
徐有功点了点头。
“对了。”
他说,“第一段跟巫蛊是一路的。”
马可抬起头。
“徐公,那您那次是怎么争的?”
徐有功答得很具体。
“我不争她冤不冤。”
“那您争什么?”
“我争律文。”
他用手指点了点那卷东西。
“律上写着:谋反者,父子年十六以上皆绞。”
“那她,”
“她不是谋反。她是巫蛊。”
他抬起头。
“巫蛊有巫蛊的条。那一条不到死。”
“就这样?”
“就这样。”
马可看着他。
“徐公,那太薄了。”
徐有功摇了摇头。
“不薄。”
他说,“薄的是讲她是个好人。”
他把律文卷起来。
“马先生,我在大理寺十几年,见过很多人替被告说好话。”
“有用吗?”
“一次也没有。”
马可想了一下,问了一个他一直想问的问题。
“徐公,您三次被判死。”
“是。”
“第三次是什么时候?”
徐有功想了想。
“长寿二年。”
“那天您在干什么?”
徐有功笑了一下。
“我在睡觉。”
马可怔住了。
“睡觉?”
“中午。”
他说得很平常。
“家里人来报,说朝上定了,绞。”
“然后呢?”
“我说知道了,接着睡。”
马可看着他。
“徐公,这个是史书上写的,还是真的?”
徐有功看了他一眼。
他没有正面答。
他说的是:
“家里人哭。”
“我说了一句:难道就我一个人死,别人都长生不死?”
他把律文放在膝盖上。
“马先生,这一句不是豁达。”
“那是什么?”
徐有功抬起头。
“是我那天什么也做不了。”
他停了一下。
“能做的,我三个月前在堂上都做完了。”
他看着马可。
“那天哭,就是把三个月前做的那些,全推翻。”
马可坐在那间零下一度的库房里。
他忽然明白了这句话的分量。
一个人在判决下来那天的样子,是给所有看着他的人看的。
他要是慌,别人就会想:原来他自己也心虚。
“徐公,那明天呢?”
徐有功站起来。
“明天你去听。”
“然后呢?”
“听完,你只做一件事。”
“哪一件?”
他说:
“问清楚期限。”
那天夜里,徐有功还说了一件事。
这件事马可后来记了很久。
“武后有一回问我一句话。”
“问什么?”
“她说:卿比断狱多失出,何耶。”
“什么意思?”
徐有功解释了一下。
“判案有两种错。”
“哪两种?”
“失入,是把不该重判的判重了。”
“失出,是把该重判的判轻了。”
他抬起头。
“她说我总是往轻里判。”
“您怎么答的?”
徐有功说了八个字。
“失出,臣小过。”
“下一句呢?”
“好生,圣人大德。”
马可坐在那间零下一度的库房里。
他忽然想起自己那六条。
第三条:低于存入价,已付部分不追。
十月那个争议堆:高于判定等级,我补差价;低于统货,不追。
去年二月那四百五十二块:不追。
这些全是失出。
他这一年做的每一条规矩,都在往农户那一边轻判。
“徐公,那我这个,”
徐有功打断了他。
“马先生,你先别高兴。”
马可停住了。
徐有功站起来,走到库门口。
他背对着马可,说了一句很重的话:
“我失出,用的是律。”
他转过身。
“你失出,用的是什么?”
马可站在那儿,一句话也没说。
因为答案很清楚。
去年那四百五十二块,用的是他自己的钱。
今年那个补差价的承诺,没有钱。
而明年那三十个库,用的是三千万财政资金。
“徐公,我懂了。”
“你说。”
马可说:
“拿自己的钱失出,是小过。”
他停了一下。
“拿公家的钱失出,就不是小过了。”
徐有功点了点头。
“这就是他们把你那第三条改成三成的道理。”
他把律文夹在腋下。
“那个改法是对的。”
马可站在那儿,忽然觉得心里空了一块。
他为那一条,从二月争到十月。
争了十个月。
今夜有一个一千三百年前、三次被判死的人告诉他:那个改法是对的。
他坐在那张塑料椅上,很久没有动。
过了大概两分钟,他问了一句:
“徐公,那我这十个月,是白争了?”
徐有功摇了摇头。
“不白。”
“哪儿不白?”
徐有功把那卷律文重新展开。
“你争的时候,把那一条为什么改不了,弄明白了。”
“这有什么用?”
他抬起头。
“马先生,一条你争不过的规矩,你有两种败法。”
“哪两种?”
“一种是没争过,你到死都以为是他们坏。”
他停了一下。
“另一种是争过,你知道了它为什么在那儿。”
他把律文卷起来。
“第一种,明年你还会为同一条撞墙。”
“第二种呢?”
徐有功站起来。
“第二种,明年你会去改别的地方。”
马可抬起头。
“徐公,改哪儿?”
徐有功往库门口走了两步。
外面在下雪。
“你那一条改不了,是因为损失落在公家账上。”
“是。”
“那你把损失挪到别处去。”
“挪到哪儿?”
徐有功回过头。
“这个我不知道。”
他说得很坦白。
“我只知道:一条规矩改不动的时候,别去撞它。”
“那去哪儿?”
他往雪里走。
“去看它挡住的那件事,还有没有别的路。”
段四·钩子结尾
十二月十八日上午十点,反馈。
卢组长念的。
一共三条。
第一条,念的是举报信第二段。
「经核查,属实。
定性:项目相关人员以个人资金参与项目关联经营活动,未履行事前报备程序。
关于『利益输送』:该笔交易高于市价的部分,全部支付给农户;交易整体为净亏损;且当事人已于核查前主动书面说明。不予认定。
整改要求:今后此类行为,一律事前书面报备。」
第二条,念的是第三段。
「经核查,属实。
整改要求:争议果差价补偿承诺,须明确资金来源与年度上限,形成书面制度,报县级主管部门备案后执行。
在完成备案之前,暂停执行。」
马可在这一条上,抬了一下头。
「暂停执行」四个字,意味着刘忠民那九块九,二月填不了。
卢组长看见他抬头了。
他停下来,说了一句:
“马先生,这一条你有意见可以现在提。”
马可想了几秒。
他说:
“我提一条。请把『暂停执行』改成『暂停对外承诺,已作出的承诺按原约定执行,并在备案材料中单独列出』。”
卢组长看了一眼计财处那位。
那位想了想,点了点头。
卢组长在稿子上改了几个字。
然后他念第三条。
第三条很短。
「关于反映的第一项:
该同志系特聘专家,非在编,无签批权限,文件手续完备。
鉴于该同志身份特殊,且项目日常管理事实上高度依赖其个人,建议由项目运营主体明确一名具有中国国籍及法人资格的直接责任人,签署整改承诺书,并对本项目日常管理承担直接责任。
限三十日内落实并报厅备案。」
念完,会议室里安静了。
卢组长把稿子放下。
“马先生,这一条,不是处分。”
“我知道。”
“这一条是给你们留了一条路。”
马可点了点头。
他知道这一条是什么意思。
这一条的意思是:
这套东西可以继续,可是它上面那个名字,得换一个人。
“卢组长,三十日是到什么时候?”
卢组长翻了一下日历。
“一月十七日。”
马可从那间会议室出来的时候,是上午十一点二十。
外面在下雪。
他站在村委会院子里,掏出本子。
他在上面写了一行:
「一月十七日之前,找一个人。」
下面他列了名单。
这个名单他昨天夜里就在心里列过一遍。
能满足三个条件的人:中国国籍、在这个项目上有法人或负责人身份、肯签字。
第一个:王志远。合作社法人。
第二个:村支书。
第三个:县果业局的人。
第四个:强磊。
他写到第四个的时候,停住了。
强磊不是法人。
强磊二十六岁,月薪五千五,合同是手写的。
可他是这个库唯一一个每天在场的人。
马可把第四个划掉了。
他划得很用力,划穿了纸。
划完,他又看了一遍前三个。
第一个:王志远。
合作社法人。
这个库二〇二一年立项时五个签字的人之一。
去年冬天,那四万五垫资款就押在他管的公账上。
八月九日,他在一张空白纸上写了三行字,说这个库从一开始就不该建在这儿。
从条件上讲,这是唯一一个三样全占的人。
从人情上讲,这是最不可能的一个。
第二个:村支书。
姓周,五十来岁,跟老周不沾亲。
这一年里,他来过库上四次。
每一次都是有上面的人来的时候。
他没有反对过任何事。
他也没有支持过任何事。
马可在他名字后面写了三个字:
「问一次。」
第三个:县果业局。
这个最像是正路。
可它有一个毛病:县果业局要是接了,这个库就变成县上的项目。
县上的项目,第一件事是并进县里的统一台账。
那本六栏加一页空白的账,会被换成县里的标准表。
马可在这一条后面写了一行:
「能办成。可办成以后,就不是这个东西了。」
马可看着这三个名字,站在雪地里。
他忽然发现一件很难受的事。
这三个人,他都不熟。
这一年多,他在这个塬上认识的人里,最熟的是强东林、强磊、李叔、老周。
这四个人,一个都不在名单上。
强东林是农户。
李叔七十一。
老周是西安的果商,跟这个项目没有法律关系。
强磊没有法人资格。
他掏出笔,在那张纸的最下面写了一行:
「我这一年,把所有的信任,都建在了不能签字的人身上。」
写完,他盯着这一行看了很久。
然后他在旁边加了一句:
「这不是意外。」
「是因为能签字的人,从一开始就没进过这件事。」
他把本子合上,走回院子。
强磊在库那边等着。
他昨天在里面待了两个小时零十分钟。
马可走过去,没有问那两个小时。
他问的是:
“冷不冷?”
强磊说:
“不冷。”
两个人站在那儿。
过了一会儿,强磊说了一句:
“马哥,卢组长跟我说了一句话。”
马可抬起头。
他知道自己现在不该问。
卢组长说过:你问了,他答了,你们两个人的话就都不算数了。
可强磊接着说了。
他没有等马可问。
“他问完最后一个问题,把本子合上了。”
强磊说,“然后他说了一句,说这句不记录。”
“他说什么?”
强磊看着那栋库房。
“他说:小伙子,你今年二十六。”
他停了一下。
“他说:这些东西,别都记在一个人名下。”
然后他抬起头。
院子那头,有一个人站在雪里。
是王主任。
他手里拿着一个塑料袋。
看样子是刚从谈话那间屋子出来。
他站在那儿,看着马可。
看了大概五秒钟。
然后他转过身,往院门外走了。
一句话也没说。

追到院门口,他喊了一声:
“王主任!”
那个人停住了。
他没有回头。
马可站在他后面五六米的地方。
雪下得不大,可风很硬。
“王主任,我想跟您说一句话。”
那个人还是没有回头。
过了大概三秒钟,他说了一句。
声音不大,可马可听见了。
“马先生,今天不行。”
他停了一下。
“我刚跟他们讲了一个半小时。”
他这才转过身。
他的眼睛是红的。
“我讲了二〇二一年那五个签字。”
他说,“我讲了二〇二二年二月。”
他停了一下。
“我还讲了那四个小时。”
马可站在雪地上,一句话也没说。
那四个小时,是二〇二五年十一月二十四日夜里的断电。
修理师傅查明是人为。
配电箱钥匙三把。
其中一把在他手上。
这件事,一年了,没有人问过他。
马可也没有问过。
王主任站在那儿,等了几秒。
他大概是在等马可问那一句。
马可没有问。
他说的是另一句:
“王主任,您回去歇着吧。”
那个人看了他一眼。

附录一·Dongpo's Note
Xu Yougong sat down on the plastic chair at the store door at eight in the evening on the second night, fifty-odd, thin, in a worn green official's robe, carrying a rolled scroll of statute.
Three days. Four people: Lu, forty-seven or so, from the department's discipline inspection group; a man from finance in his thirties; a man from the audit office, about fifty, who did not speak once; and a young minute-taker.
Lu opened with three sentences. We are not here to decide whether you are guilty; we are here to verify whether three things happened. You may decline any question and we will record "declined to answer." And: item eight, you added that yourself? Yes. He wrote a line and said neither good nor bad.
Day one, the documents. The audit man read slowest, page by page, and stopped at page thirty-five, which is blank apart from one printed line: this page belongs to the recorder. Why is it blank. Qiang Lei: because to today I have not found anything that did not add up. The audit man did not ask again. He copied the page number into his own notebook.
The afternoon was the wall. Who set the six iron clauses — me. Who cut them — a sign shop in the county town, October 2025, 420 yuan, receipt exists. What are these four pages — my own provenance. Has anyone ever investigated you over it? No. Then why write it? Because I needed seven households to put their fruit into this store.
He read Wang Zhiyuan's ballpoint line aloud, off the blank sheet, in front of everyone, and then asked who Wang Zhiyuan is, and wrote the name in his notebook.
Day two, interviews, and I waited six hours in the yard at minus eight. Qiang Donglin forty minutes. Li fifty. Liu Zhongmin twenty. Wang Zhiyuan one hour forty. Qiang Lei two hours ten.
Liu came out and told me what he had said: that his three crates cost him 9.90, and that there is a column on that page left blank until February. They asked whether he believed it. I said I don't know whether I believe it. I said I signed.
Xu Yougong asked what I was thinking about, and I said I was considering explaining to Lu why I had done all of this. He shook his head at once. Do not. Explain your reasons and he is obliged to judge your reasons, and the matter turns from did this happen into was it worth it. The first can be checked. The second cannot. And what cannot be checked is settled by the mood of whoever is in the room.
His own record: three times condemned to death under Wu Zetian. The first for a woman surnamed Pang, wife of Dou Xiaochen, accused of sorcery — a useful charge, he said, because it requires no physical evidence. Which is the same species as paragraph one of my letter: the two paragraphs that can be checked are the survivable ones.
How did he argue it? Not that she was wronged. He argued the statute. Treason carries strangulation for males over sixteen; she was charged with sorcery, and sorcery has its own article, and that article does not reach death. That is all. I said it was thin. He said the thin argument is the one that says she is a good person — he spent a decade at the Court of Judicial Review watching people vouch for defendants, and it never once worked.
Then the exchange with the empress: you frequently err toward release, why is that.* Two kinds of error — 失入, punishing beyond what is due; 失出, punishing less. Eight characters back: to err toward release is a small fault in a servant; to prefer life is a great virtue in a sage.
And I sat there in a store at minus one realising that everything I have built this year is 失出. Clause three: not clawed back. The disputed pile: I pay up, I do not claw back. The 452: not clawed back. Every rule I wrote leans toward the farmer.
*He stopped me before I could enjoy it. I erred toward release using the statute. What are you using?
Last year the 452 was my own money. This year's top-up promise has no money at all. And next year thirty stores run on thirty million of public funds.
Erring toward release with your own money is a small fault. Erring toward release with public money is not a small fault. — which is the reason they diluted clause three to thirty percent. He said it plainly: that amendment was correct.
I argued that clause from February to October. Ten months. Tonight a man who was sentenced to death three times told me the other side was right.
Findings, read out at ten on the eighteenth. Paragraph two: substantiated, characterised as personal funds in project-linked trading without prior filing; conveyance of benefit not upheld — the above-market portion went entirely to farmers, the transaction was a net loss, and the party disclosed it in writing before the review. Paragraph three: substantiated; the top-up undertaking must have a stated source and annual cap, be written up and filed with the county authority, and is suspended pending filing.
I objected once, to that word, and asked for "suspend new undertakings; undertakings already made are honoured per their original terms and listed separately in the filing material." Finance nodded; Lu changed the wording on the page.
Paragraph one is not a finding at all. Appointment papers complete, no signing authority, everything in order — and therefore: the operating entity is to designate one person of Chinese nationality with legal-person standing to sign an undertaking and bear direct responsibility for day-to-day management. Thirty days.
Lu: this is not a penalty, this is a road left open. I know what it is. It means the thing may continue and the name on top of it has to be somebody else.
Thirty days. 17 January.
Snowing when I came out at 11:20. Four names on the list: Wang Zhiyuan, the party secretary, someone from the county fruit bureau, and Qiang Lei — who is not a legal person, is twenty-six, earns 5,500 a month on a handwritten contract, and is the only human being present at that store every day. I crossed him out hard enough to go through the paper.
And when I looked up, Wang Zhiyuan was standing across the yard in the snow with a plastic bag in his hand, just out of the interview room. He looked at me for about five seconds and walked out of the gate without saying anything. — M.*
附录二·Marco's Memo
Memo to file. Luochuan village committee, 16–18 December. Night one hundred and thirteen.
1. Review team: 4 (discipline inspection lead Lu; finance; audit; minute-taker). Three days: documents / interviews / findings.
2. Operating principle adopted from Xu Yougong on night two, and it governed everything I said on day three:
Answer facts, not motives. The moment you supply your reasons, the question changes from did this happen to was it worth it. The first is verifiable and bounded. The second is unverifiable and therefore resolved by the disposition of whoever is in the room.
Corollary, from his ten years at the Court of Judicial Review: character evidence for a defendant has never once worked. He won the Pang case not by arguing she was wronged but by arguing that the article charged does not carry death.
3. 失出 / 失入. Erring toward under-punishment versus over-punishment. Asked by the empress why he consistently erred toward release: to err toward release is a small fault in a servant; to prefer life is a great virtue in a sage.*
Every instrument I have built is 失出: clause three, the 452, the disputed-pile top-up. And his correction, which I did not want: he erred toward release using the statute; I err toward release using money. Mine last year, nobody's this year, and thirty million of public money next year.
Therefore the dilution of clause three to 30% was correct. I contested it from February to October. I was wrong, and I was wrong in a specific way: I treated a rule that worked at 984 jin of my own money as if it scaled to 15,000 tonnes of public money. It does not. A discretionary loss-absorption clause is a small virtue on a private balance sheet and an unbounded liability on a public one.
Record this as the largest single error of the year.
4. Findings, 18 December.
(a) Paragraph two — substantiated. Characterisation: personal funds in project-linked trading without prior filing. Conveyance of benefit: not upheld, on three grounds — the above-market portion went wholly to farmers; the transaction was a net loss; the party disclosed it in writing before the review. Remedy: prior written filing for all such acts hereafter.
Note: the third ground is the one my 5 December statement bought. It did not prevent the finding. It removed the characterisation that would have ended the project.
(b) Paragraph three — substantiated. Remedy: stated source, annual cap, written into a rule, filed with the county authority. Suspended pending filing.
I objected to "suspended" and obtained: suspend new undertakings; those already made are honoured per original terms and listed separately. One sentence, agreed in about fifteen seconds, and it is the difference between Liu Zhongmin's column being filled in February and not.
Lesson: the only amendment I won in three days was a scope carve-out for commitments already made to a named individual. General principles moved nothing. A specific person with a signature on a page moved it immediately.
(c) Paragraph one — no finding. Papers in order, no signing authority. And then the operative sentence: the operating entity shall designate one person of Chinese nationality with legal-person standing to sign an undertaking and bear direct responsibility for day-to-day management. Thirty days: 17 January.
5. Assessment of (c). It is not a penalty and Lu said so. It is the institution declining to resolve an unresolvable status question and instead requiring that somebody local absorb it. Structurally identical to what I have been asking farmers to do all year: sign your name against something you do not fully control.
I have spent a year building instruments that make that demand of other people. This is the first time the demand has been routed back at me, and I cannot satisfy it personally — by definition.
6. Candidate list (Chinese nationality + standing in this project + willing): — Wang Zhiyuan, cooperative legal representative. The only one who satisfies all three structurally. — Village party secretary. Standing yes; willingness unknown; no involvement to date. — County fruit bureau. Would require the county to take the project onto its own books. — Qiang Lei. Not a legal person. Struck out.
7. Two things from the interviews I did not arrange and could not have.
Liu Zhongmin, on whether he believes the February column will be filled: I don't know whether I believe it. I signed. That is a more useful sentence in a review file than any endorsement.
Qiang Lei: two hours ten minutes, the longest of anyone, more than double his father's. I have not asked what was said and will not.
8. Wang Zhiyuan stood in the snow across the yard for about five seconds after his own hour and forty minutes, and left without speaking.
I do not know what that was. I am recording it because in eight months of this man, every single thing he has done has arrived late and unannounced and has turned out to matter.
附录三·English Highlight
"To err on the side of release is a small fault in a servant; to prefer life is a great virtue in a sage."
Xu Yougong served at the Tang Court of Judicial Review under an empress and the informer-magistrates, and was three times sentenced to death and three times restored. On one of those occasions his household wept and he ate and slept as usual and asked whether he alone was to die and everyone else would live forever.
His method was not courage. The first case that nearly killed him was a woman accused of sorcery, and he did not argue that she was innocent or wronged. He argued the statute: treason carries strangulation, she is charged with sorcery, and the article on sorcery does not reach death. That is the whole argument. Told it seemed thin, he said the thin argument is the one that says the defendant is a good person, and that in a decade of watching people vouch for defendants he had never once seen it work.
Which produced the advice that governed a three-day review: answer facts, not motives. Explain your reasons and the question stops being did this happen and becomes was it worth it — and the first is checkable and bounded, while the second is settled by the temper of whoever is in the room.
And then the part that cost more. Asked by the empress why he so consistently erred toward release, he gave the eight characters above. Every rule the analyst had written that year erred the same way: losses not clawed back, differences made up, shortfalls absorbed.
He erred toward release using the statute. The analyst erred toward release using money — his own, last year; nobody's, this year; and thirty million yuan of public money next year.
A clause that absorbs a farmer's downside is a small private virtue and an unbounded public liability, and the officials who had diluted it ten months earlier had been right the entire time. He had argued against them from February to October, and was told so by a man who had been condemned to death three times for arguing the other way.
